Bike Trail Attacker Sentenced To 17 Years In Jail

A man accused of sexually assaulting a woman on the Oregon Rotary Bike Trail in March 2023 was sentenced to 17 years in prison on Friday, June 27, in Wisconsin Circuit Court, in addition to time already served for a previous conviction.

According to online court records, Richard Victor Cunningham, Jr., was found guilty of felony second-degree sexual assault/use of force and will serve a 32-year sentence, including 17 years of original incarceration and 15 years of extended supervision. The court read and subsequently dismissed lesser felony charges of strangulation, suffocation, and bail jumping.

According to the court’s order, he is not to have any direct or indirect contact with the victim or any member of her family, and he will be placed on the lifetime sex offender register, as well as GPS monitoring. The victim made a statement at Friday’s sentencing.

Cunningham, Jr., 44, was facing felony charges in connection with an alleged March 23, 2023, attack on a woman who was walking on the trail near Highway D and managed to flee to a nearby residence for help. He was later arrested at his home on April 5.

Cunningham, Jr., had already been convicted of second-degree sexual assault/use of force in a 2021 incident, for which he received a 20-year sentence to be served consecutively, prior to this most recent sentencing.
