A 23-year-old woman, frustrated with a tenant eviction, is accused of using poisonous bug foggers in an attempt to force a family — including a 4-year-old child — out of an apartment, according to police and media reports.
An arrest warrant obtained by Fox 17 states that Ervyana Davis initially contacted police for help evicting a family from an apartment but was told to pursue a civil eviction process. Instead, she allegedly bought between five and sixteen insect foggers and placed them in areas where the toxic fumes would leak into the unit.
At the time, the family was still inside the apartment, and the young child began coughing and required hospitalization due to inhalation of the chemicals. The rest of the family did not suffer major injuries, according to reports from Law&Crime and Fox 17.
The Environmental Protection Agency (EPA) warns that:
-
No one should remain inside a building being fumigated.
-
Reentry should be delayed by at least two to four hours.
-
A single fogger is typically sufficient for a 25 ft. by 25 ft. room.
Davis was arrested and charged with:
-
Two counts of felony child abuse
-
One count of misdemeanor child abuse
Authorities have not yet released further details on the child’s condition or Davis’ court proceedings.
