Another lawsuit has been filed in relation to the tragic chemical leak that occurred at the Pemex refinery in Deer Park back in October.

On October 10th, two lives were tragically lost and 35 individuals sustained injuries.

A recent lawsuit has been filed in connection with the tragic death of Jose Perez, a 28-year-old contractor who lost his life while working at the Pemex facility.

The family of the deceased man has filed a lawsuit against Pemex and two other companies, alleging that his death could have been avoided.

A lawsuit has been filed in Harris County, accusing Pemex, Shell USA, and PMI Services of North America of negligence. The 30-page lawsuit claims that the companies failed to take appropriate measures, resulting in a chemical leak at the Pemex refinery in Deer Park. Tragically, the incident led to the injury of 35 individuals and the loss of two lives.

“The families are not seeking to bring back their loved ones. What they truly desire is to ensure that such a tragic incident never occurs again. According to Benny Agosto Jr., Managing Partner at Abraham Watkins Law Firm, this incident could have been easily prevented if people had simply followed the necessary procedures and safety regulations.”

Attorney Benny Agosto Jr. is representing the Perez family, and he states that Perez was in a neighboring unit at the time of the incident. Despite his attempts to escape, Perez lost consciousness before he could make it out.

Agosto and their team of engineers have conducted a thorough investigation of the Pemex site.

Agosto recounted a situation where a work order had been improperly executed. He emphasized the importance of accompanying contractors during work permits to ensure adherence to safety protocols. In this particular instance, contractors had commenced work on a pipe without properly isolating it. As a result, poisonous gas was released, highlighting the potential hazards that can arise from not following proper procedures.

The lawsuit alleges that Pemex, PMI Services, and Shell USA have committed numerous violations. These include not following proper evacuation procedures and neglecting equipment maintenance.
