Man accused with strangulation waives his right to a speedy trial

The person who was allegedly strangled earlier this year near Spencerville requested on Monday that her attacker be kept in custody for as long as possible, according to prosecutors.

At a pre-trial hearing for Ty Shellenbarger Jr., 20, of rural Spencerville, a request was made for a trial date continuation until Sept. 24. Shellenbarger had been indicted by a grand jury in June on one count of strangulation, a felony of the third degree. During the hearing held on Monday, Shellenbarger voluntarily waived his constitutional right to a speedy trial.

Currently, Shellenbarger remains in the Auglaize County jail with a cash or surety bond of $150,000. His attorney, Scott Kelly, has requested Judge Jeffrey Reed to consider reducing the bond amount. However, if the bond is posted, it would require house arrest and a GPS ankle monitor. Assistant Prosecutor Joe Everhart representing the state of Ohio has argued that the bond is currently set at an appropriate level.

When it was her turn to speak, the alleged victim in the case, who is a small girl, requested that Shellenbarger’s bond remain unchanged. Everhart had asked for her testimony before making a decision. The girl revealed that this was not the first time that Shellenbarger had attacked her.

The young girl expressed her fear and unease about the release of the individual in question. She stated that she did not feel safe and was not okay with his release from jail. She went on to say that she did not have faith that this would be the last time he would pose a threat and admitted to not trusting him. Her feelings of terror were palpable.

Shellenbarger’s bond was lowered by Reed to $100,000 cash or surety. If the bond is posted, the judge ordered house arrest and electronic monitoring.

As per the legal documents, the Allen County Sheriff’s Office received a call on May 5th reporting an assault and strangulation of a woman by Shellenbarger at 1250 S. Sunderland Road, Spencerville. Upon arrival, the deputies were greeted by the alleged victim’s mother, who had received a distressing text from her daughter requesting to be picked up from Shellenbarger’s residence.
