FREMONT — One man is in hot water after swimming in a pool on the Fourth of July, remaining defiant throughout the incident.
Justin K. Moreno, 35, from the 7800 block of South Wayne Street, Hamilton, was arrested Friday in the 200 block of West Albion Street, Fremont. He faces charges of Level 6 felony intimidation and misdemeanor disorderly conduct.
A probable cause affidavit filed in Steuben County courts states that local police responded to a trespassing complaint in the 200 block of West Albion Street. The resident reported an unknown white male had just exited the pool and walked away.
They found Moreno hiding behind a blue trash can on Coffin Street. He was shirtless, in wet swim trunks, and allegedly intoxicated. He claimed he had been swimming at the Bull Pen Cafe, one block north, and had never been to the woman’s residence, though his car was still parked in her driveway.
Officers offered to let Moreno walk home if he was sober enough, but he got angry and refused to cooperate.
“You should remember me,” he shouted. “It took eight officers to handle me last time.”
Moreno was arrested and transported to the Steuben County Jail, where he tried to take on the entire staff while still handcuffed. They “took him to the ground” and added leg shackles.
Deputies then took him to Cameron Memorial Community Hospital for medical clearance, but he “continued yelling and taunting hospital staff, patients, and police officers.” The staff asked him to quiet down because children were nearby, but Moreno shouted, “I don’t give a f***!”
He had to be restrained again when he tried to leave, telling police, “Wait until you see me without these cuffs, you’ll know my name.” Once medically cleared for incarceration, he was transported back to the jail.
If convicted, he faces a maximum two-and-a-half-year prison sentence and a $10,000 fine.
